Welcome to CODEBOOKUSA. These Terms of Service ("Terms") govern your access to and use of the CODEBOOKUSA website, mobile application, and services (collectively, the "Service"). By creating an account, purchasing a product, or using the Service in any way, you agree to be bound by these Terms.

1. Who We Are

CODEBOOKUSA ("we", "us", "our") is a digital platform that sells and delivers electronic editions of trade and construction code books, technical guides, and related study materials to professionals and students in the United States.

2. Eligibility

You must be at least 18 years old to create an account or make a purchase. By using the Service you represent that you meet this requirement and that any information you provide is accurate and current.

3. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for any activity that occurs under your account. You agree to notify us immediately at [email protected] if you suspect unauthorized use of your account.

4. Purchases and Digital Delivery

All purchases made through CODEBOOKUSA are delivered digitally. Upon successful payment, the purchased title is added to your personal library and becomes immediately accessible from any device where you are signed in.

Prices are listed in U.S. dollars and may change at any time. Applicable taxes will be added at checkout where required by law.

5. License Granted to You

When you purchase a code book or other digital product through CODEBOOKUSA, you receive a limited, non-exclusive, non-transferable, revocable license to access and read that product for your own personal or professional use. You do not acquire ownership of the underlying content or any copyright in it.

Code books sold through the Service are published by third parties such as the NFPA, ICC, IAPMO, ASHRAE, and others, and are protected by U.S. and international copyright laws. CODEBOOKUSA and its licensors retain all rights, title, and interest in and to the Service and its content.

7. Refund Policy

Because digital products are delivered immediately and cannot be "returned," all sales are final. We may, at our sole discretion, issue a refund if a product was charged in error, was not delivered, or is materially defective. Refund requests must be submitted to [email protected] within 14 days of purchase.

8. User Content

The Service allows you to create highlights, bookmarks, notes, and study progress records. You retain ownership of this content. By creating it on the Service you grant us a limited license to store and display it back to you across your devices.

9. Acceptable Use

You agree not to use the Service to: (a) violate any applicable law or regulation; (b) infringe the intellectual property rights of others; (c) distribute malware or engage in any activity that disrupts the Service; or (d) attempt to gain unauthorized access to any part of the Service or the accounts of other users.

10. Third-Party Services

The Service uses third-party providers for authentication (Google, Apple, Supabase), payments (Stripe), and hosting (Cloudflare). Your use of those features is also subject to the applicable third party's terms and privacy policies.

11. Disclaimer of Warranties

The Service and all content are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. CODEBOOKUSA does not warrant that the Service will be uninterrupted, error-free, or free from harmful components, and does not guarantee the accuracy, completeness, or currency of any code book or technical guide. Always verify code requirements with the authority having jurisdiction before relying on them for real-world work.

12. Limitation of Liability

To the maximum extent permitted by law, CODEBOOKUSA and its officers, employees, and suppliers shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of the Service. Our total aggregate liability for any claim arising out of these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless CODEBOOKUSA from any claims, damages, liabilities, and expenses (including reasonable attorney fees) arising out of your use of the Service or your violation of these Terms.

14. Termination

We may suspend or terminate your account at any time if you violate these Terms or if we suspect fraudulent or abusive activity. Upon termination, your license to access purchased content will end.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, for material changes, provide additional notice (such as an email or in-app notification). Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the United States and the state in which CODEBOOKUSA is organized, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in that state.
